Planning Proposal to amend Wingecarribee LEP 2010 - Boundary Adjustment at 35 Elizabeth Street and 4 Old Bong Bong Way Burradoo

Background:

On 16 August 2023 Council resolved to proceed with a Planning Proposal to include land at 35 Elizabeth Street and 4 Old Bong Bong Way Burradoo within Schedule 1 (Additional Permitted Uses) of WLEP 2010.

The intent of the amendment is to enable a boundary adjustment between adjoining lots at 35 Elizabeth Street and 4 Old Bong Bong Way Burradoo. The proposed amendment would limit the resulting lot at 35 Elizabeth Street Burradoo to a minimum area of at least 9,300 m2 to ensure no further subdivision potential.

On 20 November 2023, the NSW Department of Planning Housing & Environment issued a Gateway Determination to progress the Planning Proposal to public exhibition. The Proposal is now exhibited in accordance with the Gateway requirements and submissions sought from the community.

Documentation associated with the proposal is available on the NSW Planning Portal (NSW Planning Portal) as well as at the Customer Service Counter at the Civic Centre in Moss Vale.


When is the exhibition period?

The Planning Proposal is on public exhibition for a period of 40 days. It will open from Monday 25 March 2024 and close on Friday 3 May 2024.

Only written submissions can be considered and must be received by Council before 4.30 pm on Friday 3 May 2024 and quote file reference PP-2023-2084.

If you make an anonymous submission, Council will be unable to contact you further. A summary of the points made in your submission will be contained in the Council meetings business paper and made public on Council’s website.

It is noted that Wingecarribee Shire Council is authorised to exercise the functions of the Minister for Planning under s.3.36 of the Environmental Planning & Assessment Act 1979 as have been delegated to it with regard to this Planning Proposal.


Next steps:

Following the completion of the exhibition period, any submissions received will be considered by Council and a report prepared for the Local Planning Panel. The advice received from the Panel will be incorporated into a report to Council.

If the Proposal is still supported, in either its original or a varied form, dependent on submissions, Council will liaise with the Parliamentary Counsel’s Office to finalise the amendment to the Local Environmental Plan. If the Proposal is no longer supported no amendment will occur.
